The BitSmart Warranty We guarantee our products and labor will perform within specification for a period of 1 year from the date of installation or delivery, unless otherwise specified. In some cases the actual manufacturers warranty and service applies. We reserve the right to repair or replace material or work deemed defective by BitSmart Corporation. Warranty covers diagnosis and repair or replacement of any defective part, but does not cover consequential loss of data, or down time. Every effort will be made to preserve data and minimize downtime. Preservation of customer data will incur separate costs that are not covered by this warranty and will be billed at our normal rates. It is the customers responsibility to back up their data. We cannot be responsible for software conflicts or work done by others not autorized by BitSmart Corporation. We will, at your request, try to resolve these and any problems you are having, at our regular hourly or contract rate. We will also not be responsible for the cost of repair or replacement of work or products provieded by BitSmart Corporation, which is done by personnel not authorized by us. We try to use the finest materials and incorporate the best practices in the work we do. We also attempt to respond to your needs in a very prompt and timely manner. If you have any questions regarding the quality of our work or products, or if work that we have done or products that we have sold do not seem to be performing, as they should, please bring these issues to our attention aas soon as possible. We will address any warranty isues ina timely way. It is our highest objective to provied you with the best products and services at competitive prices. If, on a project, we begin to approach a problem that is outside our area of expertise, we will bring this to your attention. If we know of a reference or subcontractor that we can bring in to provide that service, we will suggest that option. If there are no options available to support that work needed, we will at your request, and at our regular rates, research and try to accomplish the task required. We will not walk away from an unfinished project unless asked to do so. BitSmart Corporation makes no other warranty, expressed or implied. Neither party shall be liable for the other for any kind of damages that arise out of the services provided under this agreement. All claims and disputes relating to this agreement in excess of the limits of the Small Business Court shall be decided by arvitration in accordance with the Arbitration Rules of the American Arbitration Association unless the parties mutually agree otherwise. Second Year Warranty When offered, the second year warranty is a limited warranty. Full labor is covered to replace the failed component, however the value of the component is depreciated from 100% of the original value at the beginning of the second year to 0% at the end of the second year. This value may be applied to upgraded replacement components at the time of service. |
